Usage of Copyrighted Images in Webpages
Recently, the question of whether unauthorized use of copyrighted images or audio data in webpages is a violation of said copyright or not has become a topic of debate in newsgroups. The subject has also been brought directly to the attention of GAINAX.
The majority of these discussions have centered around the use of images from our own animated TV series, "Shinseiki Evangelion" (Neon Genesis Evangelion).
As a result of deliberations between ourselves and "Evangelion's" copyright holder, King Records, we have settled on the following guidelines regarding inclusion of images from "Evangelion" in webpages. Please read them through if you use or are planning to use "Evangelion" images in your webpage.
Permissible Data
On receipt of a request for use, we will give permission for inclusion of the following types of data in webpages. Note, however, that if this data is put to uses that are not to the benefit of Gainax or King Records, we will withdraw any such permission.
Permission is available for usage of original images, i.e., made from scratch and not copied from existing materials, contingent on informing GAINAX of intent to do so.
We are also preparing image data files here at GAINAX for inclusion in webpages as well. Please contact us if you wish to use any of them. After doing so, you may download the files here.
Requesting Permission to Display Graphics
After consultations with King Records, it was decided that GAINAX would handle all such requests directly.
Whether your request concerns files of your own creation, or those which we provide, go to the "EVANGELION" Image Usage Request Form page to make your application.
There will generally be no verification or response from this end. You may start including the requested files in your webpage as soon as you have sent us your application.
We will also be putting up links to webpages from which we receive requests for inclusion.
Some people may also have pages in which, while not themselves including graphics such as these, they will want to include links to pages dealing with Evangelion. After ensuring that the pages one wishes to link to are not in conflict with these guidelines, please inform us of your link at the above email address.
Things to Remember When Including Authorized Datafiles in Webpages
When including such files, be sure to specify on the pages in which they appear that their use is with GAINAX's permission. Also, do not permit the data to be downloaded by others.
Example: "The 'Neon Genesis Evangelion' images in this webpage are used with permission of GAINAX Co., Ltd. Copying, distribution or usage in other webpages is prohibited."
These graphics are in JPEG format. Permission is granted to change the file format as well as reduce the number of colors and the image size, but if the copyright notice within the images becomes difficult to read, we ask that you rewrite it next to the graphic so that it can be understood.
Data For Which No Permission is Available
Be advised that GAINAX cannot give permission for usage of the following types of data in webpages:
- Music Data
- (including melodies, lyrics, and self-performed pieces as well as pre-recorded materials)
- Other Audio Data
- (sampling of dialogue, sound effects, etc., from TV, video or other sources)
- Animation Data
- (moving images captured from video or other sources)
- Image Data Not Otherwise Authorized
- (images taken from magazines, merchandise, TV, video, or other sources)
GAINAX is also currently investigating the feasibility of getting authorizations similar to those described above from companies involved with its other productions.
